1. Introduction
Welcome to Homely AI (the "Service"). This Agreement (the "Terms") is a legal contract between you and the Homely AI Team ("we," "us," or "our"). It is important that you read and understand these Terms carefully. By downloading, installing, or using the Homely AI mobile application, you acknowledge that you have read, understood, and agreed to be bound by this Agreement, effective from the date of your first use.
If you do not agree to all of these Terms, you are not authorized to use the Service. In such cases, you must promptly cease all use and remove the application from any mobile devices under your possession or control.
2.AI Service Disclaimer
Our services are powered by innovative AI technology. Please understand that generative AI is an evolving field, and we cannot guarantee the complete accuracy or suitability of the designs produced.
Although we work hard to filter and refine the data, AI-generated content may occasionally contain errors or unintended results. We recommend using Homely AI for creative inspiration rather than as a definitive guide for construction or professional design. Homely AI is not responsible for any issues or damages arising from your use of or reliance on AI-generated content. We strongly advise consulting with licensed architects or professional contractors before initiating any physical renovation or landscaping projects.
3.User Conduct and Guidelines
To ensure a safe and professional environment, all users must abide by the following rules. Failure to comply with these guidelines will result in the immediate revocation of your access to the Service.
Prohibited Actions: You are strictly prohibited from:
• Misusing Technology: Attempting to reverse-engineer, decompile, or disrupt the Service, or creating derivative works based on our technology.
• Unauthorized Distribution: Renting, leasing, lending, or sub-licensing the Service to any third party.
• Malicious Use: Using the Service to provide medical advice, harm minors, or create verifiably false information for malicious purposes.
Content Restrictions: You represent and warrant that any "Input Content" (such as photos of your home) you upload is owned by you or that you have obtained all necessary permissions. You agree not to upload or generate content that:
• Infringes on any third-party intellectual property, privacy, or publicity rights.
• Is illegal, defamatory, obscene, hateful, or encourages violence and discrimination.
• Contains images of minors or sensitive personally identifiable information.
If you do not agree with any part of these guidelines, you are not authorized to use Homely AI and must immediately uninstall and delete the application from all your devices.
4.Age Limitation
To use Homely AI, you must be at least 18 years old. If you are between 13 and 17, you may only use the Service under the direct supervision of a parent or legal guardian who agrees to these Terms on your behalf. By allowing a minor to use these Terms of Service, the parent or guardian assumes full responsibility for the minor's compliance with this Agreement. We do not knowingly collect information from children under 13; if we discover such data has been provided, we will take immediate steps to delete it and terminate the associated access.
5. Service Availability and Termination
We reserve the right to modify, suspend, or terminate the Service or any of its features at any time, with or without notice. We may also restrict or terminate your access if we determine, in our sole discretion, that you have violated these Terms.
Sharing and Third-Party Interaction: While the Service may allow you to share generated content to third-party social media platforms, you are solely responsible for such actions. Homely AI assumes no liability for your interactions with others outside the Service or for any consequences arising from the content you choose to share.
Data and Termination: Upon termination for any reason, you remain bound by the applicable provisions of these Terms. You are responsible for all mobile data charges incurred through the use of the Service.
6.Security and Liability
While we strive to protect your data, no mobile technology is 100% secure. By using Homely AI, you acknowledge that your information and generated content may be subject to security risks beyond our control. You agree that Homely AI shall not be liable for any unauthorized access to your device or data resulting from such risks. Your use of the Service is at your own risk.
7.Subscriptions and Payments
Certain premium features within Homely AI require a paid subscription. Pricing is displayed within the app and may vary by region. By selecting a plan, you agree to the fees and terms presented at the time of purchase.
Billing and Renewal: Payments will be charged to your iTunes/Apple ID Account at the confirmation of purchase. Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period at the rate of your selected plan.
Managing Subscriptions: You can manage or turn off auto-renewal in your Apple ID Account Settings at any time after purchase. Please note that deleting the app does not automatically cancel your subscription.
Refunds: All financial transactions are processed by Apple. Subscription fees are non-refundable by Homely AI. If you wish to request a refund, you must do so through the Apple App Store, subject to Apple's refund policies.
8. Third-Party Services and Disclaimer
Homely AI may facilitate interaction with third-party platforms. We do not control and are not responsible for the content or practices of these third parties.
The Service is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties and shall not be liable for any errors, service interruptions, or damages arising from your use of the Service or any linked third-party resources.
9.Limitation of Liability and Indemnification
In no event shall Homely AI, its team, or affiliates be liable for any indirect, incidental, special, or consequential damages, including loss of profits or data, arising from your use of the Service, even if advised of the possibility of such damages.
You agree to indemnify and hold harmless Homely AI and its affiliates from any claims, liabilities, or expenses arising out of your use of the Service, your violation of these Terms, or your infringement of any third-party rights.
10. Intellectual Property
All content within the App—including but not limited to source code, UI/UX design, visuals, graphics, fonts, and generation algorithms—is owned by Homely AI or our licensors. These are protected by copyright, trademark, and other intellectual property laws.
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, and revocable license to use the Service and its Output (generated designs) solely for your personal, non-commercial purposes.
11. Legal and Miscellaneous
By using Homely AI, you represent and warrant that (i) you are not located in a country subject to a U.S. Government embargo or designated as a “terrorist supporting” country; (ii) you are not listed on any U.S. Government list of prohibited or restricted parties; and (iii) you will comply with all applicable local laws in your jurisdiction.
These Terms and any disputes arising from your use of Homely AI shall be governed by and construed in accordance with the laws of the State of New York, USA, without regard to its conflict of law principles. You agree to submit to the exclusive jurisdiction of the competent courts located in New York.
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect. Upon termination of these Terms for any reason, all licenses granted to you shall cease, and you must immediately stop using the Service and delete the application from your devices.
