1.Overview
Homely AI (referred to as "we," "us," or "the Service") is committed to protecting and respecting your privacy. This Privacy Policy explains how we collect, use, disclose, and protect your information, as well as the choices available to you regarding your data. This policy applies to all visitors, users, and others who access the Service ("Users"). For the purposes of the General Data Protection Regulation (GDPR) and other applicable data protection laws, we act as the data controller for the personal information processed through the Service.
By using Homely AI, you acknowledge that you have read, understood, and agree to the practices described in this Privacy Policy. We may update this Privacy Policy from time to time to reflect changes in our practices or legal obligations. We encourage you to review this page frequently to stay informed. If you do not agree with these practices, please do not use the Service.
2.User Control and Data Ownership
We believe you should own and control your personal data. Whether you use the Service on a free or paid basis, you have the right to choose what information you provide. You may opt to withhold certain information or restrict our collection and processing of your data through your device settings. Please be aware that if you choose not to provide necessary information (such as access to your camera or photos), you may not be able to use certain features or take full advantage of the Service's capabilities.
From the moment you agree to our Terms and this Policy, Homely AI acts as the Data Controller. This means we are responsible for determining the purpose and means of processing your personal data to provide and improve the Service.
3.Information We Collect
We collect information to provide, improve, and secure our Service. This information falls into three categories:
Information You Voluntarily Provide: To provide our core home design services, we collect the content you voluntarily submit, including the photos you upload ("Input Content") and the style-specific images generated by our AI ("Output Content"). Additionally, if you choose to communicate with us directly, we collect your name, email address, the text of your message, and any files or attachments you optionally choose to provide to assist with your request. When you submit "Input Content" for AI generation, this data is transmitted to secure third-party servers for real-time processing. This transmission is necessary to perform the service's primary function.
Information Collected Automatically: When you use Homely AI, we and our third-party partners automatically collect certain technical data to ensure the Service remains stable and efficient. This includes device and usage data such as your IP address, device identifiers (GAID/IDFA), operating system, language preferences, and App interaction logs, as well as diagnostic information like crash logs and performance data. Furthermore, if you subscribe to premium features, we receive purchase confirmation records from the App Store to provide you with the requested services; however, we never store any of your personal payment details or credit card information, ensuring that all transactions are handled with high-standard security by the platform provider.
App Permissions: To function correctly, the App requires your explicit permission to access specific features on your device, which you can manage in your system settings. This includes Camera access to take photos of your home directly within the App, Photo Library (Read/Write) access to allow you to upload existing photos and save generated designs to your device, and the Network State to determine if you are connected to the internet.
4. How We Use Information
AI Image Generation: Specifically, your uploaded images and selected style preferences are used to synthesize new design concepts. This process involves transmitting encrypted data to our AI partners, which is then deleted or de-identified after the session to protect your privacy.
Service Implementation and Optimization: We use your information primarily to fulfill your requests, such as processing your uploaded photos to generate customized interior design concepts and delivering the specific features you seek within the App. To ensure a high-quality experience, we utilize automated processing and tools like Google Analytics to monitor service performance, gain insights into user behavior trends, and detect technical issues. This data allows us to continuously refine our AI algorithms and optimize the App's stability and responsiveness, ensuring that operating procedures remain simplified and efficient for every user.
Security, Compliance, and Support: Your information is essential for maintaining a safe environment. We use device and interaction data for identity authentication, real-time risk monitoring, and the prevention of fraud or illegal activities. In accordance with the California Consumer Privacy Act (CCPA) and other applicable laws, we store and maintain records to fulfill legal obligations, responding to requests from law enforcement or government agencies when required by court orders or regulations. Additionally, we use your contact details to provide timely technical assistance and respond to your inquiries, ensuring that your feedback directly informs our service improvements.
Marketing and Business Development: With your consent, we may use technical identifiers to provide personalized advertisements and information that better fit your interests. In the event of strategic business changes—such as a merger, acquisition, or asset sale—your information may be evaluated or transferred as part of the business assets. We also utilize technologies like cookies to ensure secure logins and improve overall responsiveness, all while adhering to the instructions provided at the time of data collection to protect your legitimate rights and interests.
5. How We Share Your Information
Sharing Principles and Scenarios: We strictly adhere to our data protection commitments and never rent or sell your personal data to third parties. We may share non-identifiable technical data—such as information from cookies and device identifiers—with partners providing advertising and analytics technologies to optimize our services. Additionally, we provide limited access to necessary information to trusted service providers under strict contractual constraints. In cases of joint service offerings, your information will only be shared after we have clearly identified the partner and their privacy policy.
Refunds and Transactions (Apple): When you subscribe to our services, all transactions are managed by Apple. If it becomes necessary to process a refund request, we may need to share relevant personal data with Apple to assist in their review process. By subscribing, you are deemed to have consented to this specific data sharing for the purpose of facilitating your refund. You maintain the right to withdraw this consent at any time by contacting us at [email protected] , though opting out may affect our ability to assist with your refund requests.
Third-Party Responsibility and Disclosures: To provide our core AI design features, the photos you upload and your design prompts are shared with trusted third-party AI service providers (such as cloud-based generative AI engines). These partners process your data solely to generate the design results you request. We ensure these third parties provide a level of data protection equivalent to our own and do not use your data for their own independent purposes. While we facilitate a seamless experience, we do not control the practices of third-party platforms or websites linked within our Service. We are not responsible for their privacy policies and cannot guarantee absolute data safety during transmission to third parties. Furthermore, we may disclose your personal information when explicitly required by law, or in good faith to protect our legal rights, ensure user safety, or respond to government requests. In the event of a merger, acquisition, or asset sale, your information may be transferred as part of the business assets, and we will provide prominent notice of any such change in ownership.
6. Information Retention and Deletion
We retain your personal information only for the duration necessary to perform application functions and fulfill our legal obligations. To protect your privacy and ensure data security, generated images are stored temporarily and automatically deleted from our systems after a designated period. We strive to ensure that data is not kept longer than required for the purposes for which it was collected, maintaining a balance between service efficiency and user privacy.
You have the right to request the deletion of your personal information and the closure of your account at any time. Upon such a request, we will take reasonable steps to remove your data from our active databases. However, please be aware that certain information may be retained for a reasonable period—not exceeding what is necessary—to comply with specific legal requirements such as taxation, accounting, and auditing. We also reserve the right to retain certain data for the purposes of maintaining security, preventing fraud, and ensuring essential data backups, always in accordance with applicable laws.
7. Disclosure of Information
We do not sell your personal data. We may disclose your information only in the following cases:
• With Your Consent: When you choose to share content to third-party social media.
• Legal Requirements: To comply with laws, legal processes, or government requests.
• Protection of Rights: To protect the safety, rights, or property of Homely AI, our users, or the public.
8. International Privacy Rights (GDPR & CCPA)
EU/EEA Residents (GDPR): If you are a resident of the European Union or EEA, you possess comprehensive rights regarding your personal data. These include the right to access a complete copy of your data, the right to correct any errors, and the right to request erasure (the "right to be forgotten") when there is no longer a legal basis for processing. You may also object to processing based on legitimate interests, request the portability of your data in a structured, machine-readable format, or ask us to restrict further processing under certain conditions. If our data processing relies on your explicit consent, you may withdraw it at any time, though this may limit your access to certain authorized features. You also have the right to lodge a complaint with your local data protection authority.
California Residents (CCPA/CPRA): If you are a California resident, you have the right to know the categories of personal information we collect, the sources of that information, and the third parties with whom it is shared. You may request the deletion of your personal data and opt-out of the "sale" or "sharing" of your information with third-party service providers for advertising or market analysis. We are committed to non-discrimination, meaning we will not deny services, reduce quality, or adjust pricing simply because you choose to exercise these privacy rights. You may also designate an authorized agent to make these requests on your behalf through our designated contact channels.
9. Childrens' Privacy
Our services are strictly not intended for children under the age of 13 (or the applicable legal age in your jurisdiction). We do not knowingly collect personal information from minors. If you are a parent or legal guardian and discover that your child has submitted information to us without consent, please contact us immediately. Upon verification, we will take prompt measures to permanently delete such information from our systems to safeguard the privacy of minors.
10. Contact
